Terms of Service

1. Acceptance of Terms

By accessing or using BannerForge ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

BannerForge is an AI-powered tool that generates display ad banners from website URLs. The Service scrapes publicly available website content, generates marketing copy using AI, and renders banner images in standard advertising formats.

3. Accounts

• You must provide accurate information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must be at least 18 years old to use the Service.
• One person may not maintain more than one free account.

4. Subscription Plans & Payments

• Free: 3 generations per month, PNG format only, watermarked output.
• Pro ($19/month): 50 generations per month, all formats, no watermark.
• Enterprise ($49/month): Unlimited generations, all formats, no watermark, API access.

Payments are processed by Stripe. Subscriptions renew automatically each month. You may cancel at any time through your billing dashboard. No refunds are provided for partial months.

5. Acceptable Use

You agree not to:

• Use the Service to generate banners for websites you do not own or have permission to advertise.
• Generate content that is illegal, defamatory, or infringes on third-party rights.
• Attempt to circumvent usage limits or abuse the Service.
• Reverse-engineer, decompile, or attempt to extract the source code of the Service.
• Use automated tools to scrape or bulk-access the Service beyond normal usage.

6. Intellectual Property

Your content: You retain ownership of any original content (logos, text, images) from your websites that is used in banner generation.

Generated banners: Banners generated through the Service are yours to use for advertising purposes. We claim no ownership of the output.

7. AI-Generated Content

The Service uses AI to generate marketing copy and select layouts. AI-generated content may not always be accurate, appropriate, or optimal. You are responsible for reviewing and approving all generated content before use in advertising campaigns.

8. Limitation of Liability

The Service is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service, including but not limited to: ad campaign performance, rejected ads by advertising platforms, or inaccurate AI-generated copy.

9. Account Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time from your Dashboard settings. Upon termination, your data will be deleted in accordance with our Privacy Policy.

10. Changes to Terms

We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms.

11. Governing Law

These Terms are governed by the laws of Germany. Any disputes shall be resolved in the courts of Germany.
